WHAT ARE THE EB-1A / EB-2 NIW VISAS?

EB-1A VISA

The EB-1A visa is for individuals of extraordinary ability such as professors, outstanding researchers, and executives. It is one of the visas that lets foreign nationals live and work in the U.S. long-term. It requires no PERM labor certification from the U.S. Department of Labor and is the highest U.S. priority category.

EB-2 NIW VISA

The EB-2 NIW (National Interest Waiver) visa is for people with advanced degrees or exceptional ability. Applicants in these categories whose work serves the U.S. national interest (NIW) may apply for a waiver of the Job Offer requirement.

Eligibility requirements

EB-1A Category

Extraordinary Ability Visa

Designed for individuals with extraordinary ability in the fields of science, arts, education, or business.

Must meet at least 3 out of 10 USCIS criteria, such as:

  • Receipt of lesser nationally or internationally recognized prizes or awards.
  • Membership in associations that require outstanding achievements of their members, as judged by recognized experts.
  • Published material about you in professional, major trade publications, or major media.
  • Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance.
  • Display of work at artistic exhibitions or showcases.
  • Performance of a leading or critical role in distinguished organizations.
  • Authorship of scholarly articles in professional or major trade publications or major media.
  • Participation as a judge of the work of others in the same or an allied field.
  • Command of a high salary or significantly high remuneration relative to others in the field.
  • Commercial successes in the performing arts, as shown by box office receipts or sales.

EB-2 NIW Category

National Interest Waiver Visa

Designed for individuals with advanced degrees or exceptional ability in science, arts, education, or business.

Must satisfy the following 3 core criteria:

  • The proposed endeavor has both substantial merit and national importance.
  • The applicant is well-positioned to advance the proposed endeavor (e.g., fields in STEM).
  • On balance, it would be beneficial to the U.S. to waive the job offer and Labor Certification requirements.

The key requirement is demonstrating to the U.S. government that waiving the PERM requirement is justified due to the significant benefits the applicant brings to the nation.
